These Terms of Use govern your access to and use of our services, including money remittance, savings, virtual credit cards, Esusu participation, gift card redemption, utility payments, and more. By using our app, you agree to these terms. If you do not agree, please discontinue use of the app.
2. Service Provided
2.1 Money Remitance
Users can remit money from overseas to any Nigerian bank account at competitive exchange rates.
All remittances are subject to compliance with regulatory requirements, including identity verification.
2.2 Viva Piggybank Savings
Save funds securely using the Viva Piggybank feature.
Savings terms, interest rates, and withdrawal conditions will be provided in-app and are subject to change.
2.3 Viva Esusu
Participate in group savings plans (Esusu) with agreed contributions and payout schedules.
All participants must adhere to the terms of the Esusu group, which will be detailed upon joining.
2.4 Virtual Credit Card
Users can create and manage their own virtual credit cards for secure online transactions.
The virtual card service is subject to additional verification and spending limits.
2.5 Gift Card Redemption
Redeem a wide range of gift cards through the app.
Redeemed gift card funds will be credited to your account or used for specified transactions.
2.6 Utility, Airtime, and Data Payments
Pay for utilities (e.g., electricity, cable TV), purchase airtime, and buy data bundles seamlessly.
2.7 Transaction Reversal
Funds sent to a Nigerian bank account can be reversed if the delay period specified during the transaction has not been exceeded.
Reversals may incur a fee.
3. User Responsibilities
Account Creation: Users must provide accurate and complete information, including full name, email, phone number, date of birth, address and nationality.
Security: Users are responsible for safeguarding their login credentials. Any activity conducted through your account will be deemed as authorized by you.
Compliance: Users must comply with applicable laws, including anti-money laundering (AML) and counter-terrorism financing (CTF) regulations.
Prohibited Activities: Users may not use the app for unlawful purposes, including fraud, money laundering, or unauthorized financial activities.
4. Fees and Charges
Fees for transactions, including remittance, virtual credit card services, and Esusu participation, will be displayed in-app before confirmation.
Exchange rates provided for remittance are determined by Vivapay and may vary.
5. Transaction Limits and Reversals
Limits: Transaction limits may apply based on regulatory requirements and user verification status.
Reversals: Money sent to an account or phone number may only be reversed if the recipient has not withdrawn or accessed the funds, and the set delay period has not expired.
6. Intellectual Property
All content, features, and functionalities of the app, including the name, logo, design, and software, are the intellectual property of Vivapay. Users may not reproduce, distribute, or modify any part of the app without prior written permission.
7. Limitation of Liability
Vivapay is not liable for:
Delays or failures in transactions caused by third-party providers or network issues.
Losses resulting from unauthorized access to your account due to your negligence.
Errors arising from incorrect recipient information provided by the user.
8. Termination of Use
Vivapay reserves the right to suspend or terminate your account if:
You violate these Terms of Use.
Fraudulent or unauthorized activity is detected in your account.
9. Modifications to Terms
We reserve the right to update or modify these Terms of Use at any time. Users will be notified of significant changes via email or in-app notification. Continued use of the app after updates constitutes acceptance of the new terms.
10. Privacy
Your use of the app is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the app, you consent to the collection and use of your information as described in the Privacy Policy.
11. Governing Law
These Terms of Use are governed by the laws of Nigeria and Canada. Any disputes will be resolved in the courts of Nigeria and Canada.
